What is this about?

We operate a “Facebook Page” to promote our services and offerings and to interact with our customers and visitors to the Facebook Page (hereinafter referred to as “Users”).

When you use our Facebook page personal data is processed. Below you will find information about the nature and scope of the data processing for which we are responsible under data protection law.

As the controller of this site we have entered into agreements with Facebook that govern among other things the terms and conditions of the use of the Facebook site.

How is your data processed for when you visit our Facebook page and on what legal basis?

Independent processing of user-related data by Facebook

When you visit our Facebook page or other subpages of www.facebook.com Facebook collects usage data. As a matter of principle Facebook is solely responsible for this data processing. Facebook provides information about this in the Facebook Data Policy as well as the Facebook Cookie Policy .

Processing of usage data is the joint responsibility of Facebook and Uhlhorn GmbH & Co. KG

When you visit our Facebook Page Facebook uses certain usage data (e.g. whether you have “liked” or commented on certain of our posts) – also to provide us with summarized usage statistics (so-called “Page Insights”). Usage statistics do not allow to draw any conclusions about the behavior of individual users but merely give us an overview of the use of our Facebook Page (e.g. which posts were clicked on most frequently). We do not have any access to the personal data used to generate the statistics. Facebook alone determines which usage actions are logged by Facebook and cannot be set up, changed or influenced by us in any other way.

We have the usage statistics generated by Facebook for our Facebook Page available to us in order to improve the posts published there and to make them as interesting as possible for the users. The processing is based on a balancing of interests in accordance with Article 6 Paragraph 1 Sentence 1 Lit f GDPR, which always takes your interests into account. If you are logged in on Facebook yourself, the processing also takes place in accordance with Article 6 Paragraph 1 Sentence 1 lit b GDPR in accordance with the terms of use applicable between you and Facebook.

Facebook and Uhlhorn GmbH & Co. KG are jointly responsible in accordance with Art. 26 GDPR for the processing of personal data for the purpose of compiling usage statistics for our Facebook Page.

The information on Page Insights from Facebook describes which data is processed within the framework of joint responsibility and contains the “Page Insights Supplement” in which Facebook and Uhlhorn GmbH & Co. KG have contractually determined which of them fulfills which obligations under the GDPR.

Processing of your data when communicating with us via the Facebook Page

If you contact us via the Facebook Page, e.g., for example by commenting on a post or sending to us a message via Facebook Messenger, we process your data (e.g. your name and the communication content) in order to process your request.

We may also process your data for the purpose of asserting legal claims and defending ourselves in legal disputes as well as for the prevention and investigation of criminal offenses.

The processing is carried out on the basis of a balancing of interests in accordance with Article 6 Paragraph 1 Sentence 1 Lit f GDPR, which always takes your interests into account.

How long is my data stored?

We do ourselves not store any personal data about your use of the Facebook Page.

Information that you publish on our Facebook Page (e.g. comments) or send via Facebook Messenger is stored by Facebook based on your usage relationship and can be removed there by you.

Who receives your data?

If we communicate with you via our Facebook page the personal data required for this will be transmitted to Facebook.

Otherwise we will only share your personal data with third parties if you have consented to this, if there is a legal basis to do so, or if this is necessary to enforce our rights, in particular to enforce or defend claims.

Will your data be transferred to a third country or to an international organization?

We do not transfer personal data collected via our Facebook Page to third countries (i.e. countries outside the European Union and the European Economic Area).

However we have no control on whether Facebook processes personal data in its area of responsibility in third countries and for example transfers it to Meta Platforms Ireland Limited in the USA.

What rights do you have when it comes to the processing of your data?

In accordance with legal requirements you have various rights with respect to the processing of your personal data. You have the right to access, the right to rectify, the right to erase, the right to restrict processing and the right to data portability. You also have the right to complain to a data protection authority.

a. Right to object on a case-by-case basis

You have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you which is carried out on the basis of Article 6 Paragraph 1 Sentence 1 Lit e or lit f of the GDPR; This also applies to profiling based on these provisions.

If you object we will no longer process your personal data unless we can demonstrate compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.

b. Objection to the processing of your data for direct advertising

If we process your personal data in order to conduct direct advertising you have the right to object at any time to the processing of your personal data for the purpose of such advertising; This also applies to profiling insofar as it is connected to such direct advertising.

If you object to processing for direct advertising purposes your personal data will no longer be processed for these purposes.

Only Facebook has access to user data and can take immediate action and provide information. If you are logged in to Facebook you can also make your own settings regarding data processing by Facebook in the Facebook settings yourself.
